Don’t wait! September 8, 2016 is fast approaching!
By now you’ve likely heard the stories in the media surrounding allegations of sexual harassment claims against Jian Gomeshi and Bill Cosby. Bill 132 is Ontario's new sexual violence and harassment legislation and will impact all employers, regardless of size or sector (with the exception of those under federal jurisdiction), as of September 8th.
The Occupational Health and Safety Act (OHSA) new legislative requirements mandate employers to further protect their employees against harassment and sexual harassment in the workplace, and expands on the existing Bill 168 program which came into effect June 2010.
Recently, the Ontario government implemented their action plan – “It’s Never Okay: An Action Plan to Stop Sexual Violence and Harassment”. The new legislation further obligates employers to protect their employees from harassment and sexual harassment in the workplace. It expands on existing written policies and programs.
These changes are intended to ensure employees have a clear understanding of how incidents and complaints will be handled, reassures confidentially, and provides workers with alternative reporting options. Workers will also have the right to learn of the outcomes from an investigation.
